Fields of application to individuals

The purpose of these general conditions is to define the rights and obligations of the parties in the context of the online sale of goods offered by RAYANASH to the consumer.

The customer can save/download or print the T&Cs, they can be consulted at any time under the general terms and conditions of sale section in the "practical information" section of the website.

Any order for a product requires consultation and express acceptance of the T&Cs.

By placing an order with us, you acknowledge that you are authorised and/or entitled to use our products without breaching any law or obligation to any third party. If you are an individual, you represent and confirm that you are at least 18 years old and confirm that you will use the products in accordance with all recommendations and other requirements published by us (including those set out on our site) and (where applicable) the conditions of use and requirements specified by the product manufacturer. We will only accept orders for glue, or any products containing glue, from qualified professionals and if you place an order for any of these products, you represent and confirm that you are a professional and that you will use the glues in accordance with our requirements, including those set out on our site.

Any order placed by you constitutes only an offer by you to purchase the products you have selected. Placing an order constitutes an obligation on your part to pay. On receipt of your order, we will send you an email (or emails) confirming receipt of your order and/or setting out the details of your order (including any applicable charges). These emails only confirm the details of your order and that your order has been received. They do not constitute acceptance of your order.

Order confirmation

The contractual information will be confirmed by e-mail to the address indicated by the consumer in the order form.

During the ordering process, the consumer must

Any order placed before 11am (Monday to Friday) on weekdays will be processed the same day.

Proof of transaction and payment

The computerized records, stored in the computer systems of the company www.rayanash.fr under reasonable security conditions, are considered as proof of communications, orders and payments between the parties. The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.

For each product, payment must be made by credit or debit card, or by any other means of payment specified on our site. We have the right to refuse delivery and/or cancel the contract if we do not receive full payment from you in cleared funds. We will not charge your credit or debit card until we have dispatched your order, but please note that our payment service provider will allocate the necessary funds at the time you place your order, adding them to your credit limit, even though these funds will not have been debited yet.

Offers and promotional codes

RAYANASH regularly organizes promotional offers that allow you to benefit from advantageous rates, generally in the form of a "promo code" or "Coupon code". Offers and promo codes cannot be combined; we accept 1 code per order. However, you can place several orders with the same promo code. RAYANASH reserves the right to reimburse you if this condition is not respected. Furthermore, promo codes not used during the promotional period are not retractable; they are valid for the duration of the operation (dates indicated on social networks). An order not validated during the promotional period will not be able to benefit from the offer, as it is no longer in progress.

Any promotional action including a free product cannot be the subject of a claim. A free product will not be taken back, exchanged or replaced in the event of a defect.

Product information

With regard to an Internet sale, namely a distance sale, prior to the sale, RAYANASH provides the customer with all the information provided for in Article L221-5 of the Consumer Code (in particular the essential characteristics of the good or service; the price, the date or time period within which RAYANASH undertakes to manufacture and deliver the good; its contact details, the guarantees and the terms of implementation and other contractual conditions, as well as the possibility of using a consumer mediator).

We have taken every precaution to describe all products as accurately as possible. However, some differences from the description are possible.

The price of each product will be as stated on our website at the time of ordering, except in the case of an obvious error. Our prices include VAT (where applicable) but do not include delivery charges, which will be added to the total amount due, in accordance with our delivery charges in force at the time of ordering.

Prices are subject to change at any time, but changes after ordering will not affect accepted orders.

Prices are indicated in euros including tax and are valid in mainland France and overseas, Europe and other countries around the world.

Every effort has been made to ensure the accuracy of the information presented on RAYANASH. However, neither RAYANASH nor its suppliers are responsible for any consequences, incidents, special damages resulting from electronic transmissions or the accuracy of the information transmitted, even in the event that RAYANASH has been aware of the possibility of such damages. The names and brands of products and manufacturers are used for identification purposes only.

DURATION OF VALIDITY OF THE OFFER AND ITS PRICE Our prices are valid for the day.

Delivery terms

We will process your order without undue delay and on the delivery date confirmed by us to you or, if no delivery date is specified, within 30 days of acceptance of your order. Delivery will be made to the delivery address specified when you place your order.

You may be asked to sign for your order upon delivery. If the package does not appear to be in good condition, please refuse delivery. If you are unable to inspect the contents of the delivery, be sure to sign for the “unchecked” package.

If the recipient refuses to receive the package, the refund of the order in question will be made after receipt by the sender. The delivery costs are then not refundable.

  • Colissimo against signature (with delivery insurance): Delivery from 48 hours to your home in France after dispatch of your order *
  • Chrono Relay: Delivery within 24 hours to the relay point in France after dispatch of your order * for an order placed the day before before 11 a.m.
  • Chronopost: Delivery within 24 hours to your home in France after dispatch of your order * for an order placed the day before before 11 a.m.

*Excluding weekends and public holidays

*A package without a signature indicated as delivered by the La Poste information system will be considered as delivered and not compensable.

We cannot be held responsible if you have not received it.

In the case of delivery against signature, we will assist you in filing a complaint with the carrier's customer service.

Please note: No compensation will be granted in the event of a delay in delivery due to reasons beyond the seller's responsibility.
For example: natural disaster, pandemic, health crisis, social movement or delivery delay linked to the carrier

Any order placed before 11:00 am will be shipped the same day. After that, your order will be shipped the next day. Orders placed with items "in stock" will only be shipped when the product concerned is available. For any emergency please contact us by phone so that we can take the necessary steps.
The products are delivered to the address indicated by the consumer on the order form and only to the geographical areas that we serve. All products leave our premises in perfect condition.
The customer can report to the carrier (or the postman) the slightest trace of shock (holes, traces of crushing, etc.) on the package, and if necessary refuse the package. A new identical product will then be sent to you free of charge.
The consumer is invited to confirm this anomaly by sending us an email, in order to handle his claim within three days (3) in order to handle the claim in better conditions. As in any shipment, it is possible to experience a delay or that the product is lost. In such a case, we contact the carrier to start an investigation. All efforts are made, for as long as necessary, to find this package. If necessary, the merchant will be reimbursed by the carrier and will deliver a new identical package at his expense.

In the event of home delivery or delivery to a relay point, we encourage you to refuse the package and note a reservation on the delivery slip (damage, product missing from the delivery note, damaged package, broken products, etc.) and report the refusal to Customer Service by email at: rayanashcontact@gmail.com, any order accepted despite the damaged package without proof of repackaging or reservation on the part of the carrier or by the transport services, cannot be the subject of a claim, you are therefore responsible if you accept the package despite everything.

DELIVERY PROBLEM DUE TO THE CARRIER

Any anomaly concerning the delivery (damage, product missing compared to the delivery note, damaged package, broken products, etc.) We advise you to inform us by e-mail in order to handle your claim in the best conditions. The consumer may also confirm this anomaly by sending the carrier within (2) two working days following the delivery date a registered letter with acknowledgment of receipt setting out said complaints. (unless the carrier cannot prove that it has given the consumer the opportunity to actually check the good condition of the delivered goods, in which case this period increases to 10 days) The consumer may send a copy of this letter to our address.

Any package subject to investigation by the carrier will not be eligible for a refund, only a credit will be offered at the end of these investigations.

Distributed delivery

Any order indicated as “delivered” cannot be returned or refunded.

Standard Colissimo without signature can be deposited in the mailbox, the customer accepts that this option is possible.

Deliveries against signature have a delivery guarantee.

However, an investigation may be made with the carrier. Remember to favor the delivery method with signature.

Order and complaint

Any order sent by our services is handled by an order preparer and is then CHECKED by another person in order to guarantee your satisfaction and the assurance of a complete order. Your order form must be kept for any claim. No order is delivered without an order form.

Any product that has been started or used, as well as a paper document, cannot be returned or refunded. Any dematerialized product (e.g. training), booklet and pre-established kits will not be refundable or exchangeable, as indicated in the product sheets for the latter.

All complaints must be made to customer service within 14 days of receipt of the order accompanied by photos/videos of the items and the packaging of the parcel, as well as the invoice.

All validated orders cannot be modified. In the event of an error, it will be necessary to return the item(s) to obtain a credit only (return costs not covered)

No credit, exchange or commercial gesture may be made beyond this.

Delivery error

The consumer may inform RAYANASH as soon as possible of any complaint regarding delivery errors and/or non-conformity of the products in nature or quality compared to the information appearing on the order form.

The formulation of this claim to RAYANASH can be made at the address rayanashcontact@gmail.com. In the event of a delivery or exchange error, any product to be exchanged or refunded must be returned to RAYANASH in its entirety and in its original packaging in impeccable condition to the ADDRESS of RAYANASH. To be accepted, any return must be reported and have the prior agreement of RAYANASH, which in the event of agreement will reship the package to the correct address. The shipping costs are the responsibility of RAYANASH, except in the case where it turns out that the product does not correspond to the original declaration made by the consumer in the return slip.

Product Warranty

We have a legal obligation to supply compliant products.

The provisions herein cannot deprive the consumer of the legal guarantee which obliges the professional seller to guarantee him against all the consequences of hidden defects in the thing sold. The warranty period is one year (1 year) from the delivery of the goods for the legal guarantee of conformity, and one year from the discovery of a hidden defect. All products modified or repaired by the customer or by any entity other than the service providers chosen by RAYANASH are excluded from this warranty. The warranty may be extended according to the terms provided. (Valid only for electrical products, except the chuck).

Correspondence training

RAYANASH offers correspondence, dematerialized, online training courses that can be completed at your own pace.

This registration does not constitute state approval.

The training courses give the right to a training certificate. We inform you that the training courses are strictly nominative and we will not accept that:

  1. The training is sold to a third party (no diploma will be issued to the person who purchased the training).

  2. The “dematerialized” videos and files are transferred to a third party (copyright).

  3. A third party has access to the videos and digital files in the student's customer account.

  4. We also will not transfer training from one account to another.

  5. Since the training courses are nominative, only the purchaser will be able to benefit from them. If you wish to offer training, the account must be created in the name of the purchaser.

  6. Training ordered or offered by a third party does not give the right to view training, files and other documents belonging to the student's account.

Correction times can vary from 48 hours to 7 days. The customer will not be able to hold the trainer or RAYANASH responsible if the deadline exceeds 7 days. The training courses are corrected in order of arrival and are accessible for a period of one year after purchase. You have one year from the purchase of your training pack to validate them.

Right of withdrawal

The right of withdrawal applies only to individuals. RAYANASH being an online sales site dedicated to professionals, the right of withdrawal cannot apply. Indeed, there is no right of withdrawal for companies. The withdrawal for professionals is considered to be a commercial gesture, and will remain exceptional. Guarantees of legal hidden defects In accordance with the legal texts in force, the Seller guarantees the Buyer against all the consequences of hidden defects in the thing sold. The Buyer is expressly informed that the Seller is not the producer of the products presented within the meaning of law n ° 98-389 of May 19, 1998 relating to liability for defective products. The Seller is liable for defects in conformity of the products sold under the conditions of Articles L. 217-4 et seq. of the Consumer Code and for hidden defects in the thing sold under the conditions provided for in Articles 1641 et seq. of the Civil Code. The cancellation period expires after 14 days from the day on which you (or a person designated by you) received the last of the products; If you decide to cancel your order after we have shipped it to you, you will have to wait for it to be returned to us before you can process the refund. Please allow 30 days for this. Some banks apply fees for sending payments abroad in their own currency. Unfortunately, RAYANASH has no control over these fees as they are ordinary bank charges charged by the sender's bank. Please note that in the event of a refund, we can only refund the amount received for the products and not the bank charges. In the event that the order has been lost, please wait 30 days before reporting it lost and requesting a refund. We ship orders by Colissimo and Chronopost who have informed us that sometimes delivery can take as long as this. We will be able to process the refund if this deadline is exceeded. -In order to exercise your right of cancellation, you must inform us of your decision to cancel the contract by a clear statement (for example, a letter sent by post, fax or email). In the event of cancellation by you within the above timeframes, you will receive a refund of the price paid for the products in accordance with our refund policy, provided that you comply with all other conditions that apply. The Buyer has a 14-day withdrawal period from receipt of their order and 14 days to return it, after this period, no return will be taken into account and the cost of returning the goods will be borne by the customer. The customer must expressly request this by email to rayanashcontact@gmail.com so that our service can send them a withdrawal form to print and fill out. All returns must be made with tracking and in appropriate packaging so that the product arrives in new condition. Any product arriving broken, dirty or used will not be taken back or exchanged. Any dematerialized product, glue, kit and training pack will not be eligible for a refund.

EYELASH RANGE

The products must not have been opened or used, even for testing purposes, the seal must be intact and if blistered, it must not be removed. Any product that has been damaged, or whose original packaging is damaged, will not be refunded or exchanged. Cosmetic products that do not have seals or blisters cannot be taken back. We refuse returns of cosmetic products, eyelash extensions. In the case of cosmetic products, eyelashes, they are excluded from the right of withdrawal by article R121.1 of the French Commercial Code, goods that cannot be returned for hygiene reasons, this therefore concerns liquid products such as eyelash glues, remover, etc. (all liquid, cream, gel products, etc.) We remind you that each product is tested before being put on sale by professionals, the results may vary from one person to another depending on their experience and know-how.

Usage rights

The use of brands and photos present on the site is strictly prohibited.

Retention of title

The products are at your risk from the time you (or anyone nominated by you) receive the products. Ownership of the products will not pass to you until we have received full payment of all sums due in respect of the products, including delivery charges.

Bloctel opposition list

Article L223-2 of the Consumer Code, the company RAYANASH is required to collect telephone data from its customer or a consumer, and informs its right to object to telephone canvassing by registering on the BLOCTEL opposition list, the right of withdrawal is applicable in the event of telephone canvassing.

Force majeure

Neither party will have failed in its contractual obligations, to the extent that their execution is delayed, hindered or prevented by an unforeseeable event of force majeure. A case of force majeure shall be considered any irresistible fact or circumstance, external to the parties, unforeseeable, inevitable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts.
The party affected by such circumstances shall notify the other within ten business days of the date on which it became aware of them.
The two parties will then come together, within a period of three months, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued. If the force majeure event lasts longer than one month, these general conditions may be terminated by the injured party.

Partial non-validation

If one or more provisions of these general conditions are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other provisions will retain their full force and scope.

No waiver

The fact that one of the parties does not assert a breach by the other party of any of the obligations referred to in the context of these general conditions of sale cannot be interpreted for the future as a claim to the obligation in question.

Applicable law

These general conditions are subject to French law. This applies to both substantive and formal rules.
In the event of a dispute or complaint, the consumer will contact RAYANASH as a priority to obtain an amicable solution.

Protection of personal data

All the data you provide to us is used to process your orders.
Under Law No. 78-17 of 6 January 1978 relating to information technology, files and freedoms, you have the right to rectify, consult, modify and delete the data you have communicated to us with RAYANASH. This right can also be exercised online.

Disputes

Any order placed through rayanash.fr
carries the customer's acceptance, without any restriction, of the general conditions of sale of RAYANASH.fr
In the event of a sale to a legal entity, any dispute relating to the sale (price, general terms and conditions, products, etc.) will be subject to French law before the Commercial Court of the registered office of RAYANASH.

Refunds, Returns, Exchanges, Replacements

No right of withdrawal for products that have been unsealed by the Buyer after delivery or that have been viewed for dematerialized products as well as those that cannot be returned for reasons of hygiene and health protection (training pack, training booklets, etc.). No refund will be made. After agreement from management, returns may be accepted and will be subject to a credit note.

Any package not received at a relay point on time will be returned to us. If it arrives in a damaged condition, we disclaim all liability and will not be able to refund it.

If you wish to return a product for any reason, we encourage you to first contact our Customer Service team. Send us an email at rayanashcontact@gmail.com to discuss the return details and have the return information forwarded to you.

You can return any item you no longer want within 14 days of receiving the package as long as it is unused and in the original packaging.

Any returned item may be refunded or exchanged for another item.

In the event that an item breaks or no longer works during the warranty period, the 14 day period will be extended.

Please note that if you receive a defective item, it is imperative to contact our Customer Service as soon as possible, within a maximum of 5 days after receipt of said item.

The customer must contact Customer Service before returning the package to discuss return details. Please note that if this is not done, we reserve the right not to accept your return.

The customer is responsible for all return costs applicable for returning items to RAYANASH.

RAYANASH will not be responsible for any loss or damage resulting from the choice of a delivery service. No refund will be made before the item(s) have been received by our teams. We therefore advise you to opt for parcel tracking.

REFUNDS

Refunds can be issued on any item returned within 14 days of ordering, once the item has been inspected by our team. Please note that we will not issue refunds on items returned damaged or that have been opened/used.

Refunds will only be issued after the returned items have been received by our Fulfilment Center team, and may take up to 10 business days to appear in the recipient's account, depending on the recipient's bank.

When returning a product for a refund, please note that the shipping costs of the original order are not included in the refund.

EXCHANGES

If you wish to exchange an item, standard return rules apply.

In the event that an exchanged item costs less than the original, RAYANASH will refund the difference or offer a credit for an amount equivalent to the difference.

If an exchanged item costs more than the original item, RAYANASH reserves the right to request payment of this additional amount. This will be done on a case-by-case basis and at the discretion of the RAYANASH team.

Host

The RAYANASH website is hosted by the service provider Shopify in the territory of the European Union in accordance with the provisions of the General Data Protection Regulation (GDPR: no. 2016-679)

The objective is to provide a service that ensures the best accessibility rate. The host ensures the continuity of its service 24 hours a day, every day of the year. It nevertheless reserves the right to interrupt the hosting service for the shortest possible periods, in particular for maintenance purposes, improvement of its infrastructure, failure of its infrastructure or if the Services generate traffic deemed abnormal.

Our responsibility

All warranties, conditions and other elements provided for by law or regulation are, in accordance with applicable laws, excluded from the contract.

Subject to the provisions set out, we are not liable for any indirect losses resulting from a side effect or indirect consequence of the main loss or damage, including, but not limited to, loss of turnover or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, or mismanagement of management or working time; of whatever nature, whether caused by tort (including negligence), breach of contract or otherwise, or (ii) for any damage resulting from your misuse of the product or your failure to comply with the instructions and prerequisites provided by us, including (without limitation) any pre-tests or allergy tests to be carried out before using products.

Subject to the provisions set out in clauses, our entire liability in contract, damage (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising out of the performance or intended performance of the contract shall be limited to the contract price (including delivery charges).

GENERAL CONDITIONS OF SALE TO PROFESSIONALS

Article 2 — Scope of application: professionals

These General Terms and Conditions of Sale are applicable, without restriction or reservation, to all sales of Products (hereinafter the "Products" or the "Product") concluded by RAYANASH with professionals (any natural or legal person, public or private, who acts for purposes falling within the scope of their commercial, industrial, craft, liberal or agricultural activity, including when they act in the name of or on behalf of another professional) (hereinafter the "Customers" or the "Customer"), via the online sales site accessible from the French version of the website www.rayanash.fr, and this, in mainland France (including Corsica), in the overseas departments and territories, in Europe, Africa and Canada.

No right of withdrawal: It is expressly specified that the right of withdrawal cannot apply to sales made to professionals, whether they are individuals or companies. If the Seller accepts the return of certain products against reimbursement, this will be considered a commercial gesture and will remain exceptional, the reimbursement then taking place in the form of a credit note.

These General Conditions of Sale specify in particular the conditions for placing orders, payment and delivery of Products ordered by Customers.

These General Terms and Conditions of Sale apply to the exclusion of all other conditions, and in particular those applicable to sales to consumers (any natural person who acts for purposes which do not fall within the scope of his commercial, industrial, craft, liberal or liberal activity) and to non-professionals (any legal person who does not act for professional purposes).

These General Conditions of Sale are accessible to any Customer prior to placing an order and will prevail, where applicable, over any other version or any other contradictory document.

The Client declares that he has legal capacity and is of legal age.

The Customer declares to have read these General Conditions of Sale and to have accepted them before his purchase. These General Conditions of Sale may be modified at any time and without notice by RAYANASH, the modifications then being applicable to all subsequent orders.

Article 2.1 ---- Return and exchange terms

Any item or order returned for whatever reason (error when ordering, defective, package returned to sender, etc.) will be subject to a credit only.

Article 3 — Products and availability 3.1. Products

The Products offered for sale by RAYANASH are those which appear on the website.

The main characteristics of the Products are presented on the Website. The Customer is required to refer to the description of each Product in order to know its essential properties and particularities.

RAYANASH cannot be held liable if non-substantial differences appear between the presentation of the Products (photos, descriptions) and the Product received by the Customer.

3.2. Availability

Product offers are subject to availability of stock.

Upon receipt of the Customer's order, RAYANASH checks the availability of the Product(s) ordered. In the event of unavailability of one of the Products, the Customer will be informed as soon as possible by email and RAYANASH undertakes, within 30 days from the validation of the order, either to deliver the Product ordered to the Customer, or to offer a similar Product to the Customer at a similar price, or to reimburse the Product to the Customer.

In the event of a stock shortage on one of the Products in the Customer's order, RAYANASH will ship the remainder of the Customer's order, accompanied by an information message. In this case, the Customer will be entitled either to a refund for the Products that are out of stock or to obtain similar Products instead.

Validation of the order by the Customer constitutes acceptance without restriction or reservation of these General Conditions of Sale.

3.3. Order process

When ordering, the sale will only be considered final after RAYANASH has sent the Customer confirmation of acceptance of the order, and after the Customer has received the full price or agreed deposit. It is the Customer's responsibility to check the accuracy of the order and to immediately report any errors.

When ordering via the website, the Customer must follow the ordering steps mentioned on the site.

The Seller reserves the right to refuse orders for the same Product in abnormally large quantities.

Article 4 — Prices

Prices are expressed in Euros, are established in accordance with current legislation and apply to all Customers on the same date and are exclusive of shipping costs, unless expressly agreed otherwise between the parties.

RAYANASH reserves the right to modify its prices at any time but undertakes to apply the prices in force appearing on the website www.rayanash.fr, on the day the order is registered by RAYANASH, subject to availability on that date.

Prices do not include processing, shipping, transport and delivery costs, which are charged in addition, under the conditions indicated on the RAYANASH website and calculated prior to placing the order. The payment requested from the Customer corresponds to the total amount of the sale, including these costs.

Possible specific orders from the Customer may be considered. If applicable, they will be the subject of a quote previously accepted by the latter. The quotes established by RAYANASH are valid for a period of one month, from their date of establishment. The order on quote is only considered accepted after the payment of a deposit, the amount of which is specified when ordering.

An invoice is established by RAYANASH and given to the Customer upon delivery of the Products ordered.

The Customer does not benefit from discounts in the event of cash payment or based on the products purchased.

Article 5 — Payment Terms

The following payment methods can be used:

By bank card: Visa, MasterCard, other credit cards.

By transfer: you must make your transfer for the entirety of your order

Default of payment: RAYANASH reserves the right to refuse to make a delivery or to honor an order from a Customer who has not fully or partially paid a previous order or with whom a payment dispute is currently being administered.

Late payment: In the event of late payment and payment of the sums due by the Customer after the payment date appearing on the invoice sent to the latter, late payment penalties calculated at the annual interest rate of 10% of the price appearing on said invoice will be automatically and automatically acquired by the Seller, without any formality or prior formal notice.

Finally, a fixed compensation for recovery costs, in the amount of 40 euros will be due, automatically and without prior notification by the Customer in the event of late payment. The Seller reserves the right to ask the Customer for additional compensation if the recovery costs actually incurred exceed this amount, upon presentation of supporting documents.

Anti-fraud checks: As part of these procedures, our services may ask you for the documents necessary to release your order: proof of address and debit in your name, identity document, etc.

These requests are made by email or any other means. RAYANASH reserves the right to refuse an order that appears abnormal or fraudulent given its payment terms, quantities, information transmitted to RAYANASH.

Article 6 — Delivery Terms

The methods and times for shipping the order are as follows:

- Colissimo: Delivery "against signature" from 48 hours on average to your home in France after dispatch of your order *

- Colissimo: Delivery "without signature" from 48 hours on average to your home in France after dispatch of your order *

- Colissimo service point: Delivery from 2 days on average to the relay point in France after dispatch of your order *

- Chronopost: Next day delivery before 6 p.m. in France from Monday to Friday after dispatch of your order *

- Delivery to Europe, French Overseas Territories, worldwide: Delivery between 5 and 10 working days depending on the area after dispatch of your order * subject to force majeure: bad weather, strike, health crisis, pandemic, etc.

*Excluding weekends and public holidays.

Any order placed before 11:00 am will be shipped the same day. After that, your order will be shipped the next day. Orders placed with Products “in stock” will only be shipped when the Product in question is available.

A package without a signature indicated as delivered by the La Poste information system will be considered delivered and not damaged. We cannot be held responsible if you have not received it.

In the case of delivery against signature, we will assist you in filing a complaint with the carrier's customer service.

Any package subject to investigation by the carrier will not be eligible for a refund, only a credit will be offered at the end of these investigations.

The Product ordered is delivered by post or by carrier proposed by the Seller to the address appearing on the order form.

Article 7 - Return/exchange of Products

The Customer is invited to check the apparent condition of the packaging and if possible the type of Product at the time of delivery and before signing the delivery note. If the packaging is not in good apparent condition or if the type of Product does not correspond to that ordered, the Customer must refuse the package and note a reservation on the delivery slip (package refused because opened or damaged) accompanied by his signature and indicate it to RAYANASH by email or by post to the address: rayanashcontact@gmail.com. Failing to have refused the package, the Customer is invited to address the problem to the carrier and to RAYANASH within three (3) days from delivery.

The Customer must also check the model of the Product delivered and the condition of the Product within a reasonable period of five (5) days. If the Products have been damaged or are not compliant, the Customer must imperatively within a reasonable period of five (5) days indicate to RAYANASH that he refuses the order by email or by mail to the address rayanashcontact@gmail.com and return the Products at his expense to RAYANASH at the address below: 60 RUE François Ier 75008 Paris FRANCE in their original packaging.

Unless expressly agreed in advance in writing by the Seller, and provided that the reciprocal receivables and debts are certain, liquid and due, no compensation may be validly made between any penalties for late delivery or non-conformity of the Products ordered by the Customer on the one hand, and the sums owed by the latter to the Seller for the purchase of said Products on the other hand.

Article 8 — Retention of title clause – Transfer of risks

The transfer of ownership of RAYANASH Products to the Customer will only be carried out after full payment of the price by the latter, or possibly of the commercial paper issued in representation of this price, regardless of the date of delivery of said Products.

Regardless of the date of transfer of ownership of the Products and delivery of the Products, the transfer of risks of loss and deterioration will be carried out upon delivery of the Products to the carrier. The Products therefore travel at the Customer's risk.

Article 9 — Liability of the Seller

The parties shall not be held liable if the non-performance or delay in the performance of any of their obligations results from a case of force majeure.

By express agreement, a case of force majeure is the impossibility of obtaining supplies from a supplier, a delay by a supplier or a subcontractor or a carrier even if all the conditions referred to in Article 1218 paragraph 1 of the Civil Code are not met, as well as any case meeting the conditions referred to in Article 1218 of the Civil Code.

Article 10 — Intellectual property

RAYANASH remains the owner of all intellectual property rights to photographs, presentations, studies, drawings, models, prototypes, etc., produced (even at the request of the Client) with a view to providing the Products to the Client.

The Customer therefore prohibits any reproduction or exploitation of said photographs, presentations, studies, drawings, models and prototypes, etc., without the express, written and prior authorization of the Seller, who may make it conditional on financial compensation.

Article 11 — Guarantees

The Products delivered by RAYANASH benefit from a contractual guarantee under the conditions set by the manufacturer and the legal guarantee of hidden defects. However, the guarantee of hidden defects does not apply to the professional Customer of the same specialty as RAYANASH.

The warranty forms an inseparable whole with the Product sold by RAYANASH. The Product cannot be sold or resold altered, transformed or modified.

This warranty is limited to the replacement or reimbursement in the form of a credit note for Products that are non-compliant or affected by a defect.

In order to assert its rights, the Customer must, under penalty of forfeiture of any action relating thereto, inform RAYANASH, in writing, of the existence of the defects within a maximum period of one (1) month from their discovery, this period constituting a foreclosure period.

RAYANASH will replace or repair any Products or parts under warranty deemed defective. This warranty also covers labor costs.

The replacement of defective Products or parts will not have the effect of extending the duration of the warranty set out above.

The warranty cannot apply if the Products have been subject to abnormal use, or have been used in conditions different from those for which they were manufactured, in particular in the event of non-compliance with the conditions prescribed in the instructions for use.

It also does not apply to cases of deterioration or accident resulting from impact, fall, negligence, lack of supervision or maintenance, or in the event of transformation of the Product.

Article 12 — Processing of your personal data

The personal data collected is subject to processing for which the controller is the company RAYANASH, whose address is located at 60 RUE François Ier 75008 Paris FRANCE.

To find out how your personal data is processed (purposes, recipients, retention period, etc.) by RAYANASH, and to be informed about your rights over this data, we invite you to consult our privacy policy.

In accordance with the applicable regulations regarding personal data, you have the right to access, rectify, oppose, limit the processing, erase and transfer your data, which you can exercise by email or by post to rayanashcontact@gmail.com, specifying your surname, first name, address and attaching a copy of both sides of your identity document.

In the event of difficulty relating to the management of your personal data, you can submit a complaint to RAYANASH, the contact for the management of personal data within the RAYANASH company, or to the CNIL or any other competent authority.

Article 13 — Applicable law, disputes

If a dispute or litigation exists despite all the care taken in the execution of its obligations by RAYANASH, the Customer is invited to write to RAYANASH to try to resolve this difficulty by indicating the references of his order, the reasons for his dispute and his/her requests.

The contractual relationship is subject to French law. In the event that these General Terms and Conditions of Sale are translated into one or more languages, only the French text shall be authentic in the event of a dispute. All disputes relating to the validity, interpretation, execution, termination of these terms and conditions or their consequences shall be submitted to the courts of PARIS.

Article 14 - Pre-contractual information - Customer acceptance

These General Conditions of Sale are expressly approved and accepted by the Customer, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely on any contradictory document and, in particular, its own general conditions of purchase.
